Exposure Draft Security Legislation Amendment (Critical Infrastructure Protection) Bill 2022

​​​​​The Australian Government is committed to protecting the essential services all Australians rely on by continuing to uplift the security and resilience of critical infrastructure and systems of national significance.

Having identified the need for an enhanced regulatory framework, the Government enacted the Security Legislation Amendment (Critical Infrastructure) Act 2021 (the SLACI Act) which built on existing requirements under the Security of Critical Infrastructure Act 2018 (SOCI Act).

In particular, the SLACI Act expanded the coverage of the framework from four sectors (water, electricity, gas and ports) to eleven sectors and 22 asset classes; introduced a government assistance measure; cyber incident reporting obligations; and expanded the requirement to provide owner and operator information to the Register of Critical Infrastructure Assets across the new asset classes.

The Government is now seeking submissions on a second set of amendments to the SOCI Act. The Exposure Draft of the Security Legislation Amendment (Critical Infrastructure Protection) Bill 2022 (the SLACIP Bill) proposes further amendments to the SOCI Act to enact a framework for risk management programs, declarations of systems of national significance and enhanced cyber security obligations.

Stakeholder feedback has already shaped the Government’s critical infrastructure security framework. As part of the next stage of reforms to the SOCI Act, we are seeking your views on the Exposure Draft of the SLACIP Bill​.

The Department invites public submissions from interested parties. Submissions on the Exposure Draft of the SLACIP Bill close at 9:00am (AEDT) on 1 February 2022. Make your submissions via CI.Reforms@homeaffairs.gov.au. Please identify whether your submission is confidential or public. Public submissions may be published on the Department's website.

The Department will hold virtual town halls on the Bill in December and January. A final town hall will be held in early February will summarise the key feedback from the consultation process.​​
