One (1) | I determined that an individual ceased to be an Australian citizen under section 36D as:
- they had been convicted of two offences against provisions specified in section 36D(5) and sentenced to periods of imprisonment that total at least 3 years; and
- I was satisfied that the person's conduct to which the convictions related demonstrated that the person has repudiated their allegiance to Australia; and
- I was satisfied that it would be contrary to the public interest for the person to remain an Australian citizen; and
- I was satisfied that the person would not become a person who is not a national or citizen of any country as a result of the determination to cease their Australian citizenship.
