Can my family come to Australia without applying as part of a 'split family' under the Humanitarian Programme?

Yes your family may come to Australia under the Humanitarian Programme if they are proposed by:

  • an Australian citizen
  • an Australian permanent resident
  • an Australian organisation
  • an eligible New Zealand citizen

and they meet all requirements for a Class XB visa.

If your family member arrived in Australia as an illegal maritime arrival on or after 13 August 2012 they are not eligible to propose under the Humanitarian Programme.

If your family member is mandated as a refugee by the United Nations High Commissioner for Refugees (UNHCR) and referred to Australia for resettlement, they may be eligible for a Refugee visa within the Class XB visa series.
