The exposure draft (PDF 1.5MB) of the Customs Regulation 2015 remakes the Customs Regulations 1926 (the Regulations), which are due to sunset on 1 April 2015.
The exposure draft proposes changes to the Regulations to significantly improve its operation. This includes deleting redundant provisions, simplifying language, restructuring provisions that are difficult to navigate, and other minor changes. The exposure draft (PDF 672KB) of the Customs (International Obligations) Regulation 2015 covers the customs provisions related to Australia’s international obligations and will complement the Customs Regulation 2015.These provisions are exempt any future sunsetting requirements and this is best facilitated by placing them in a separate instrument. See the Explanatory Statement (PDF 346KB) for further details.
We are seeking industry and the community’s views on the draft Customs Regulation 2015 and the draft Customs (International Obligations) Regulation.
Why are these changes necessary?
The Legislative Instruments Act 2003 (LIA) provides that all legislative instruments, other than exempt instruments, progressively ‘sunset’ according to the timetable set out in the LIA. The purpose of this process is to ensure that a suitable review mechanism exists so that legislative instruments remain fit-for-purpose, necessary and relevant.

We are now inviting comments from industry, peak industry bodies or other interested parties. We will use this input to inform the final Customs Regulation 2015 and Customs (International Obligations) Regulation 2015.
